Disgraced uncle rapes 9-year-old niece

A 20-year-old Bulawayo man has been sentenced to 15 years imprisonment after he was convicted of raping his nine-year-old niece.

The accused person who cannot be named to protect the victim’s identity and is from Makokoba suburb appeared before Bulawayo regional magistrate, Mr Archie Wochiunga, and was convicted of a rape charge as defined in Section 65(1) of the Criminal Law Codification and Reform Act Chapter 9:23.

In passing the sentence, the magistrate said what aggravates the offence is the age difference between the accused and the complainant, which is 11 years.

Mr Wochiunga then slapped the accused person with 15 years behind bars.
Prosecuting, Mr Owen Mugari told the court that on February 18 at around 2AM at the same address, the complainant was asleep next to her mother in the lounge where the accused person also sleeps.

The accused person stood up from his blankets and went where the complainant was sleeping and raped her while she was asleep.

Feeling the pain from her private parts, the complainant up and saw the accused person raping her, said Mr Mugari.
“She pinched him using her hands and the accused person quickly put his manhood back in his shorts and went back to his blankets,” he said.

The complainant woke her mother and narrated the ordeal to her.

“At around 9AM the complainant saw police officers passing by the road and narrated to them what had transpired, which then led to the arrest of the accused person. The complainant was referred to hospital for medical examination,” said Mr Mugari.
