Another content creator sued… Nyathi Family fight Louisa over fabrications

The Nyathi family, a well-known social media couple of content creators, Gilbert and Joyce Nyamhanhindi, have initiated a lawsuit against fellow content creator Louisa.
The family, which gained popularity for their “humble” content and captured the hearts of many on social media, has been attracting controversy in recent months.
However, despite the controversy, the couple has united against Louisa, who is also popular on social media, accusing her of spreading falsehoods that have adversely affected their reputation.
Louisa, who reportedly seemed to be taking Mai Nyathi’s side in the domestic feud recently, is now an enemy after the couple joined against her.
Through their South Africa-based lawyers, Mahuntsi Attorneys Incorporated, the couple filed a complaint on January 10, demanding a retraction, an apology, and the cessation of all defamatory statements made by Louisa.
The lawsuit follows Louisa’s appearance on DJ Ollah’s podcast on January 9, where she made allegations of Gilbert’s infidelity.
Louisa claimed that Gilbert had been caught at a lodge after attacking his wife in South Africa. She further alleged that Gilbert had taken R15,000 to Boksburg, where he booked a lodge with a girlfriend, using his wife’s number at the reception.
According to Louisa, Gilbert’s wife went to the lodge and exposed the situation.
However, the couple has alleged that Louisa used her social media platforms and her podcast appearance to disseminate false, defamatory, and malicious statements directed at them and their family.
“These include but are not limited to statements alleging that: Our client (Mrs Nyathi) contracted a sexually transmitted infection (STI); and
“Additional disparaging remarks and insinuations against our client’s parents, impugning their character, morality, and family standing.
“These statements are entirely false, unlawful, and have caused grave reputational harm, emotional distress, and public humiliation to our client and her family.
“Your conduct constitutes serious violations of South African law (since you started these malicious innuendos in South Africa.
“In the event that you relocate to Zimbabwe, we shall instruct our correspondent attorneys to deal with the matter.
“Your actions also include defamation, the unlawful publication of false statements that injure another’s reputation; Crimen Injuria, the unlawful and intentional impairment of the dignity or privacy of another person, recognized under common law;
“Sections 10 and 14 of the Constitution of the Republic of South Africa, 1996 – guaranteeing every individual’s right to dignity and privacy; Sections 14 and 69 of the Protection of Personal Information Act 4 of 2013 (POPIA) – which prohibit the unauthorized processing
and disclosure of private and sensitive personal information, including medical and family details; and Section 4(1) of the Protection from Harassment Act 17 of 2011 – which criminalizes the repeated or harmful communication that causes distress, fear, or humiliation to others,” read the letter of demand.
The lawyers said their instructions are to demand that she immediately and permanently withdraw all posts.
“Our instructions are that you withdraw all posts, recordings, interviews, and comments ,whether online, in print, or otherwise, relating to our client, her parents, or her family;
“Publish a comprehensive written retraction and apology on the same platforms where the false statements appeared, clearly and publicly acknowledging that your allegations were false and are unreservedly withdrawn; and Cease and desist from making, posting, or repeating any further reference directly or indirectly to our client or her family in any form, including podcasts, interviews, or social media publications.
“You are granted seventy-two (72) hours from receipt of this letter to comply with these demands and to provide written confirmation of full compliance.
“Failure to comply will result in our client taking immediate legal action without further notice, including: Laying criminal charges for crimen injuria, contraventions of POPIA, and harassment under the Protection from Harassment Act; and Instituting civil proceedings in a competent South African court for defamation, invasion of privacy, and emotional distress, seeking substantial damages, legal costs, and interdictory relief preventing further publication.”
Louisa allegedly claimed that Mai Nyathi had confided in her that she contracted a sexually transmitted infection from her husband, Gilbert, and had expressed concern about possible exposure to HIV.
In a joint live broadcast, recently, the couple publicly dismissed as fabrications the infidelity and abuse allegations made in a series of leaked voice notes, claiming the audio is an AI-generated creation by their “enemies.” *_-H-Metro_*
