Armed robber jailed 12 years
HARARE magistrate Noel Mpeiwa yesterday sentenced a Harare man to 12 years in jail for armed robbery.
Abel Marufu Mukandawire was found guilty of two counts of robbery.
His alleged accomplices Maxwell Stanley (32), George Zindi (49) and Maidei Mukapa (39) were and acquitted.
During trial, the quartet pleaded not guilty, denying any knowledge of the robbery.
But Mpeiwa ruled that Mukandawire was found in possession of the complainant’s iPhone 7 Plus cellphone, which was lost to the robbers.
The court further ruled that there was a witness at the former Ximex Mall complex who saw the convict selling the cellphone.
“The accounts of these witnesses are part of the evidence adduced by the prosecution,” Mpeiwa ruled.
“The cellphone was recovered through triangulation as appears in exhibit 2 and is before this court as exhibit.”
State prosecutor Tendai Tapi told the court that on June 11, 2021 along Ridgeway in Highlands, Harare, Mukandawire and his alleged accomplices robbed Funwell Mugonda of an Itel
cellphone.
On the second count, the prosecution proved that Mukandawire also robbed John Kates of goods valued at US$3 000.
On September 16, 2021, Makandawire was arrested and during interviews, he implicated the alleged accomplices. _*NewsDay*_
